Can I File a VA Claim Years After Discharge?

VA places no time limit on filing a postservice disability claim, but timing can affect the potential effective date and the evidence available.

Did You Know?

VA says there is no time limit on filing a postservice disability claim. The claim still must meet the applicable eligibility and evidence requirements.

One of the biggest myths in the veteran community is that you had to file your VA disability claim right after you got out. That's not true — and it never was.

The Short Answer

You can file a postservice disability claim after discharge without a filing deadline. Filing later can affect the potential effective date, and VA notes that developing the evidence may become more complex as more time passes.

Why Do So Many Vets Think They Can't File?

The disability process can be easy to miss during out-processing. A condition does not have to be claimed immediately after separation, but VA still decides whether the evidence establishes a current disability and the required connection to service.

What You Need to File

  1. Check whether you need an Intent to File (VA Form 21-0966). It may protect a potential effective date while you gather evidence, but some verified online applications create one automatically.
  2. Gather current VA or private medical records and other evidence relevant to the disability you're claiming.
  3. Gather your service records — DD-214, service treatment records, buddy statements.
  4. File your claim on VA.gov or with a VSO's help.

How an Intent to File Can Affect Timing

An Intent to File may establish a potential effective date if VA receives the completed application for the same benefit within one year. Starting some verified online applications creates an ITF automatically, so a separate Form 21-0966 isn't always needed. VA determines the final effective date under the rules for the claim.
