The Short Answer

You can file a VA disability claim at any time after discharge. There is no deadline. The only thing that changes is your effective date — the sooner you file, the sooner your benefits can start.

Why Do So Many Vets Think They Can't File?

Because the military doesn't do a great job of explaining this during out-processing. You get a stack of papers, a handshake, and you're out. Nobody sits you down and says 'hey, that back pain from carrying a ruck for 10 years? That's a service-connected condition and you can file for it anytime.'

What You Need to File

  1. 1File an Intent to File (VA Form 21-0966) — this locks in your effective date while you gather evidence. Do this TODAY.
  2. 2Get a current diagnosis for your condition from any doctor (VA or private).
  3. 3Gather your service records — DD-214, service treatment records, buddy statements.
  4. 4File your claim on VA.gov or with a VSO's help.

The Intent to File Is Your Secret Weapon

Filing an Intent to File takes 5 minutes and locks your effective date for one year. That means if you file the ITF today and submit your full claim 6 months from now, your benefits will be backdated to today. This is the single most important step.
